No, the issue is not with tags—the regulations deal with readers. The regulations control the amount of RF energy that can be emitted and the frequencies that can be used in order to prevent interrogators from interfering with other radio transmissions or devices that employ RF signals. If there are no readers operating, then you are not violating any regulations.
